The normal time limit for pursuing a medical malpractice lawsuit in NY is 2.5 years from the date of the alleged malpractice. However, much shorter time limits (ie 90 days) may apply if the defendant Dr or hospital is a municipal defendant. There are also certain exceptions to these time limits that my apply (ie if the person bringing the lawsuit is a minor, the time limit for them to do so may be extended up to 10 years, etc.). Because this can get very complicated and because blowing the time limit to file a lawsuit can be fatal to your claim, my best advice is to consult ASAP with an experienced medical malpractice lawyer.
