Tim:

I hate to tell you but I think most lawyers are much too cavalier about just how damaging an IME can be for their clients. I think it's important for lawyers to alert their clients to some of the typical IME tricks-of-the-trade-- claiming they performed tests they never performed, telling the client one thing and writing another thing in their report, changing my client's answers to their questions. I ask my clients to take very detailed notes after an IME (INSURANCE, NOT Independent, Medical Exam) recording things like time of arrival, waiting time, exam time, questions asked and answers given, tests performed, etc.

I truly wish this wasn't such a game with some of these hired gun Dr's but I see these methods to be the only way to effectively deal with the crooked Dr's. Don't get me wrong, there are some decent IME Dr's but they tend to be few and far between because the carriers don't want to use them again if they don't give the answers the insurance company wants to hear.

Best of luck to you!

Thanks, Jim

I was amazed at the doctor's reply in the video that he had no clue about how the errors had been made in the report. Frankly, I don't believe his explanation, nor do I think any jury would believe it either, especially when comparing the video with his report.

I'm going to videotape all of my client's physical examinations now.
