Emergency Unemployment Compensation

6:36 am NY Workers Compensation

On July 2, 2008, Governor Paterson signed an agreement allowing New York State to participate in the federally-funded 13-week extension of unemployment insurance benefits. The first week for which extended benefit payments can be made is the week ending on Sunday, July 13, 2008.

    I am currently getting benefits from this 13 week extension. I was a real life saver for us. I have a question and i have not been able to get through on the phone lines of the unemployment office. My benefit year ends and I will still have about $300 left from the extension. The original letter I got said that I may be offered a lump sum if this was the case.

    I am wondering what is going to happen next week when my benefit year ends?

    You’ve got a very specific unemployment benefit question that’s outside of what we generally do and for which I don’t have an answer. I would encourage you to continue to try to contact the folks at unemployment.

    I have been layed off from an employer since November 14th, 2008. I have still not received one payment. I have called numerous times, mailed many letters and I am still hearing it is under review. One person I was on the phone with there did tell me there had been many mistakes made by then on my claim ! Can I take legal action against them ? After all it’s been four months. What am I supposed to do ?

    I’m sorry to hear you’re having these problems. Because I practice solely in the areas of Workers’ Compensation and Social Security Disability, I don’t pretend to be an expert on unemployment. However, my suggestion would be that if the person you’re talking to at the unemployment office isn’t helping you, then you should ask to speak to a supervisor.
